Typopixo Fonts are available for a one-time fee. However, if the traffic of your website goes up, you must upgrade your license to the correct page view amount. (You only need to pay the difference.) Traffic should be based on a six-month average of stats.
NOTE: Agencies responsible for multiple clients websites, for example web design agencies or hosting providers, may not share a single Typopixo Font-license across multiple clients websites. Please contact us for more details if you need an extended license that covers that type of use.
License Agreement
In order to complete your purchase, you must agree to the following rules of usage. Remember that when you purchase a font you are only purchasing a license to use that font for your personal or business use. You DO NOT own the font. (Title to, copyright to and full ownership of Typopixo Fonts are that of the font creator(s). The creator(s) are always listed on the product page for that font.) By downloading, purchasing, or installing Typopixo Fonts, you signify your acceptance of this license agreement, and in return for a license to use Typopixo Fonts, you agree to the following terms and conditions:
1. Grant of License and Restrictions
Typopixo grants you a non-exclusive license to use the Typopixo Font for personal or business purposes according to the terms of this Agreement. If the average number of page views under which the WebFont is used exceeds the amount in your purchased price category, then you must upgrade your license to the correct page view amount.
2. Uses that are OK
You may use one Typopixo Fonts on one domain name (URL) only. This includes matching domain names with different domain suffixes. For example, myownname.org and myownname.net are acceptable under one license, providing that they display the same content, and are controlled by the same user. However, different domains must be treated as separate licenses which must be licensed separately. For example, mynameisjack.com and mynameisjill.com must purchase two licenses, even if they were to display the same content. Workplace intranets are also acceptable under these same conditions.
3. Uses that are NOT OK
You cannot link the Typopixo Fonts files across multiple domains. You cannot use these font formats on your desktop or convert to other font formats (for example, you cannot take the Typopixo Fonts and convert them to TrueType, Open Type nor any other current or future format -- if you want the use the font for any other purpose please contact us.) You cannot adapt, embed, translate, modify, reverse engineer or create derivative works based on Typopixo Fonts. You cannot give away copies of Typopixo Fonts in ways that do not comply with the rest of this agreement without the permission of Typopixo. (for example, you cannot make any Typopixo Fonts available for download on the internet, email them to friends, or trade them on file sharing networks.) You cannot resell Typopixo Fonts. You can only use Typopixo Fonts in the Web environment and only for "stylizing HTML pages." You cannot use these font formats for printing purposes, or in any merchandising scenario or for any interactive text applications where the font can be used by visitors to create or edit text. You cannot use Typopixo Fonts on subdomains at which the content is NOT controlled by you (such as Facebook, Tumblr, or other external services). You cannot remove the Typopixo-code in the CSS file that pertains to the Typopixo Fonts. Use of Typopixo Fonts is exclusive to Typopixo technologies and CANNOT be used with other technologies including Cufon, Sifr, etc.
4. Pro License: eBook
This Pro License: eBook allows customers to embed ONE (1) Typopixo Font in ONE (1) eBook product at a time, and is valid ONLY for the following formats:
Kindle AZW, iBooks, PDF, EPUB, Broadband eBooks, Mobipocket.
Please contact us if your eBook Application scenario falls outside this list.
NOTE: Games or software for non-mobile platforms (Xbox, PS3, PSP, Wii, PC, MAC, etc.) are NOT considered eBooks and are NOT covered under this Pro License: eBook. Please contact us for more details if you need an extended license that covers that type of use.
You may use ONE (1) Typopixo Font within ONE (1) eBook scenario only. For instance, you can embed ONE (1) Typopixo Font in ONE (1) eBook for multiple mobile platforms from the approved list above. As long as the eBook is identical on the multiple mobile platforms, you only need one Pro License: eBook to develop and release the Ebook. However, if you release "MyownBook" and then develop a sequel called "MyownBook 2: Part 2" that also includes the same font, you must purchase an additional Pro License: eBook. Essentially each time the font leaves your control and is distributed via an electronic device in a new scenario, you must purchase an additional Pro License: eBook
5. Pro License: Mobile Application
This Pro License: Mobile Application is valid for integrating and embedding ONE (1) Typopixo Font in ONE (1) Mobile Application product at a time, and is valid ONLY for the following operating systems:
iOS, Android, Windows Phone, Blackberry, PalmOS, WebOS, Symbian, Maemo.
Please contact us if your Mobile Application scenario falls outside this list.
NOTE: Games or software for non-mobile platforms (Xbox, PS3, PSP, Wii, PC, MAC, etc.) are NOT considered Mobile Applications and are NOT covered under this Pro License: Mobile Application. Please contact us for more details if you need an extended license that covers that type of use.
You may use ONE (1) Typopixo Font within ONE (1) Mobile Application scenario only. For instance, you can embed ONE (1) Typopixo Font font in ONE (1) Mobile Application for multiple mobile platforms from the approved list above. As long as the Mobile Application is identical on the multiple mobile platforms, you only need one Pro License: Mobile Application to develop and release the Mobile Application. However, if you release by example "MyownApp" and then develop a sequel called "MyownApp 2: Part 2" that also includes the same font, you must purchase an additional Pro License: Mobile Application. Essentially each time the font leaves your control and is distributed via an electronic device in a new scenario, you must purchase an additional Pro License: Mobile Application.
6. Backups
You can keep backups of Typopixo Fonts in the cloud, locally on a desktop, laptop or mobile device, or on a studio server, ONLY IF you, as the single user/owner is the only person who maintains the backup. It cannot be managed by numerous users.
7. Exclusivity
All rights and licenses not expressly granted to you are reserved by Typopixo. Title to, copyright to and full ownership of the Typopixo Fonts, the Typopixo trademarks, and all patent, trademark, trade name and intellectual property rights associated with the Typopixo Fonts, remain at all times the property of Typopixo and/or the Font Creator and are not at any time transferred to you or your customers.
8. Termination
Typopixo has the right to terminate your license immediately if you fail to comply with any of the terms listed in this License Agreement. Upon termination, you must destroy the original and any copies of the Typopixo Fonts and accompanying documentation. This license may be updated from time to time, with the latest version always being available on our website. If you cannot find the latest version on our website, please contact us for details.
9. Limit of Liability
In no event will Typopixo be liable to you for consequential or incidental damage (including damage from loss of business profits or savings, business interruption, loss of business information, and the like) or for claim by any party arising out of the use of or inability to use the Typopixo Fonts or the Typopixo software. Even if an Typopixo representative has been advised of the possibility of such damages, or for any claim against you by any third party.
10. Law
This License Agreement is governed under the laws of The Netherlands.
